This was because the main opposition party in the state and its candidate in the election, Senator Ademola Adeleke kicked against the result of the election and dragged the ruling All Progressives Congress and its governorship candidate, Ggoyega Oyetola to court.
The Osun State Governorship Election Petition Tribunal sitting in Abuja has dismissed the separate objections filed by the All Progressives Congress and its candidate, Gboyega Oyetola, as well as the Independent National Electoral Commission against the petition challenging their victory at the September 2018 election.
The Peoples Democratic Party and its governorship candidate in the election had filed the petition urging the tribunal to declare that he polled the highest lawful votes and should be declared the winner.
But Oyetola, APC and INEC  had filed their notices of preliminary objection contending among others that the petition was incompetent and that the court lacked jurisdiction.

Delivering the‎ lead ruling of the three-man tribunal, Justice Peter Obi, held that the objections were misconceived and struck them out.

The tribunal added that the tribunal had jurisdiction to hear the petition. There are two other reserved rulings the tribunal is to deliver before delving into the merit of the petition.

It is necessary to remember how the said election happened that led to this legal logjam as the main opposition party made its stand known earlier before heading to the court

Meanwhile, it would be recalled that the Independent National Electoral Commission (INEC) had declared Gboyega Oyetola, candidate of the All Progressives Congress in the Osun state governorship election.

Joseph Fuwape, returning officer of the election, made the declaration at the head office of the commission in OsunFuwape said Oyetola polled 255,505 votes to defeat Ademola Adeleke of the Peoples Democratic Party (PDP) who had 255,023 votes.

It subsequently fixed a rerun for Thursday. The rerun held across seven polling units in four local government areas.

The PDP has rejected the election, describing it as a charade.

Uche Secondus, national chairman of the party, had said the election exposed APC rigging formula for 2019.
Speaking with TheCable at his Ede residenceearlier on Thursday, the PDP candidate accused INEC of conspiring with the ruling party to thwart the will of the people. He said the state was under siege during the rerun, lamenting the attack on his supporters.
“This is not a free and fair election. Osun state is under siege; we are at war in Osun. They didn’t allow my party to ,” he said. It’s only APC people they allowed to . INEC and security agents have compromised. So, there is no election in Osun today. I urge INEC to cancel the election with immediate effect and declare me the winner because I’ve already won the election. ”

Voters, observers and journalists were attacked across the seven polling units where the exercise held.

Buba Galadima, Spokesman of the Peoples Democratic Party (PDP) Campaign Organisation, has revealed how the incumbent government allegedly rigged last month’s to retain its grip on power.

Galadima, an estranged ally of incumbent Muhammadu Buhari, accused the All Progressives Congress (APC)-led federal government of using the military to intimidate voters and inflate election results in its favour.

He spoke on Wednesday while appearing as a guest on Channels TV’s breakfast show, Sunrise Daily.

Galadima said the events in Rivers State were evidence of the intimidation.

“It is not an accusation, the military are good candidates of the International Criminal Court. I saw it on television where they were going to houses killing people,” the Atiku spokesperson said.

He claimed that records are available to show that Atiku Abubakar of the PDP, won the presidential election.

“They said they won and want to go to court to inspect the election materials, that is clearly to show they rigged the election.

“I am speaking with authority and I can defend it in the court of law. Have you ever heard that a respondent went to court to check the results of an election because he was not sure his agents did the right thing?” he said.
