The PDP on Tuesday urged Governor Gboyega Oyetola to shelve any plans for appellate review of a judgement that sacked him as governor last week, Premium Times reports.
The election petitions tribunal for the September 2018 governorship election in Osun State declared Ademola Adeleke winner of the election in its March 22 rulingThe tribunal found that the supplementary election that held on September 28 to make up for the inconclusive September 22 poll was illegalIt, therefore, deducted the scores of both major candidates, and found that Mr Adeleke was the true winner based on the results of the initial ballot.

Diran Odeyemi, a PDP spokesperson, in a statement Tuesday, described Mr Oyetola as ” a refined gentleman, very religious but whose gubernatorial election was favourablymanipulated by APC and to discredit his person and personal belief and we believe he will not want his integrity to be dragged into the mud.”

Mr Odeyemi said it was long acknowledged by local and international observers that the governorship poll was manipulated for Mr Oyetola against the overall verdict of the electorate, but the governor could still atone for his alleged wrongdoing by immediately vacating for Mr Adeleke.

Meanwhile, all eyes are on the Osun State governorship tussle to see how the whole issue will be settled at the end of the day. Will APC win even if it appeals against the judgment? Or will PDP still win the appeal? Who will carry the day in Osun State at the end of the legal battle? These are some of the questions that only time will tell.
 
The PDP’s advice contradicts its position on the outcome of the presidential elections, which its candidate, Atiku Abubakar, has challenged.
 
Following repeated demand by supporters of Muhammadu Buhari for Mr Abubakar to abandon tribunal petition, the PDP said both itself and its candidate would see the case through, including to the Supreme Court if necessary.

Mr Abubakar last week submitted his petition for the tribunal to declare him winner of the presidential election, alleging manipulation of results, falsified identity documents by Mr Buhari, amongst other grounds.

Moreover, the PDP and Mr Abubakar have been making fresh revelations on the election rigging claims which appear very serious that Nigerians would like to know how they could prove their case in court against the APC and Mr Buhari.
In all these, Nigerians are watching to see how all these legal tussles will be resolved. The court has a great role to play in settling these post election issues peacefully.

In another development, the Federal High Court, Abuja, has adjourned until May 7 a seeking the disqualification of President Muhammadu Buhari and the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, over alleged excess spending on campaigns.

The plaintiff through his counsel, Ezekiel Ofou, alleged that by spending over N1 billion each, the two violated the electoral law and were liable to be removed as contestants in the election.
 
At the resumed hearing on Tuesday, Mr Ofou informed the court that he had served the processes on Messrs Buhari and Abubakar through substituted means as was ordered by the court on March 5.

On the last adjourned date, Mr Ofou said he found it extremely difficult to serve the court papers on the two, who were the main defendants in the suit because of the retinue of security around themMr Ofou then moved an ex parte motion in which he prayed the court for an order of substituted service on the two major defendants which was granted by the judge.

Former Senate , Dr Iyorchia Ayu has warned the national leader of the All Progressives Congress, APC, Bola Ahmed Tinubu, against running for in 2023.

According to him, Tinubu’s quest to takeover power from President Muhammadu Buhari will erode the political gains he made so far.

He urged the APC national leader to rather support vice president Yemi Osinbajo to succeed President Buhari.

Aye, who also served in three different portfolios as minister in the cabinet of former President Olusegun Obasanjo, also expressed worry that Tinubu has aligned himself with the ‘most backward forces’ in ’s political history.

He said the political group which he has aligned himself with, will soon turn against him.

“Bola Tinubu is my brother, an excellent man, politically clever and hardworking. He has been very successful in his private life.

“But I think like I said in one of my earlier interviews, he has aligned himself with the most backward forces in Nigeria’s political history.

“Rather than liberal and progressive wing of the north, this right wing group he is working with will soon turn against him and destroy him.

“His (Tinubu’s) ambition which is becoming blind will contribute to that self-destruction. He will lose most of what he has gained as a political leader.

“If he has my opinion, I will advise him to continue to play the role of a political leader, but not aspiring to be a government leader.

“He should promote and support the candidature of Yemi Osinbajo, who is obviously an intelligent and competent person,” the ex- Senate President told Nigerian Tribune.

Former Osun State , Rauf Aregbesola says the judgment of the Petition Tribunal last Friday, which nullified the of Governor Gboyega Oyetola will not stand.

The tribunal had declared Ademola Adeleke of the Peoples Democratic Party (PDP) as winner.

Aregbesola, in a statement Wednesday night by his Media Adviser, Mr. Sola Fasure, said the was a rude shock.

He said the majority judgment, as delivered by their Lordship, did not support the cause of electoral justice and might constitute the death knell for properly conducted elections.

Aregbesola said the people rejected the majority judgment and believe that it would not stand scrutiny at the appellate court.

The statement noted that the majority judgment, which held that the rerun election conducted in seven polling units on the September 27, 2018, was illegal, null and void, was equally shocking and amounts to a travesty of justice.

He said the government would appeal the judgment, adding that the verdict would be upturned.

The former governor wondered why elections in 17 polling units would be annulled when there was no evidence of any act known to render them null and void in an election petition, such as over-voting, non-accreditation, ballot box stuffing among others.

Aregbesola contended that concern for substantive justice should have dictated that since the results from the 17 units were duly signed and adjudged by to be authentic, there should not have been any controversy over there validity.

He lamented that the tribunal has effectively disenfranchised the legitimate voters in the 17 polling units and rendered the election undemocratic.

The statement said: “In nullifying the elections in the 17 polling units, the majority judgment predicated it on what is regarded as ‘substantial non-compliance’ with the provisions of the Electoral Act 2010. The said non-compliance, according to the judgment, borders on the failure of INEC’s appointed presiding officers to record accreditation and ballot accounting on the result forms in the 17 polling units.

“There was no evidence of any act known to render election null and void in an election petition such as over voting, non-accreditation, ballot box stuffing etc.

“This much was highlighted in the dissenting judgment of the Chairman of the Tribunal in disagreeing with the majority decision.

“It must be noted that APC and its candidate were not accused of any electoral malfeasance in the 17 polling units. Rather, INEC, a common agent of PDP and APC (and indeed, all the political parties), which neither of the parties has control over was merely accused of not complying with its manual for the election, when the presiding officers appointed for the election failed to make the entries.

“Therefore, the most relevant question one would pose here is: should the tribunal allow APC to suffer as a result of the mistakes or omissions occasioned by the INEC staff? Certainly, no!”

“Equally shocking are the reasons advanced by the two justices. They advanced the proposition that elections in the seven polling units were cancelled by the state collation officer. This was not the case. There were no elections in the seven polling units, and if there was any, the onus was on the petitioners. This onus was not discharged in anyway as no results was tendered.

“The state collation officer in compliance with the margin of lead principle rightly reasoned that the outcomes of the elections could not be determined without conducting polls in the affected elections. Hence the commission’s decision to conduct supplementary elections in line with these principles.”
